Harrison Street Fort Wayne, IN 46802 (260) 423-3030 Change of Defendant's Plea - Counsel are advised at the time of the arraignment that the pre trial conference date is the deadline for the taking of a plea. Accordingly, Judge Lee's expectation is that if a plea is to be filed, it will be executed and filed of record prior to the date of the final pre trial conference. - Upon the filing of the plea agreement in the record, the case will be referred to Magistrate Judge Roger Cosbey for the scheduling of a plea hearing and the issuance of a Report and Recommendation. The trial date will be VACATED and the pre trial conference date will be converted to a plea hearing before Magistrate Judge Cosbey, or a different plea hearing date will be scheduled. - The sentencing date will be assigned, to take place before Judge Lee, on the date the plea is taken. That date will later be confirmed when Judge Lee issues the Order adopting the Report and Recommendation issued by Magistrate Judge Cosbey.
