Defense Pretrial Motions

-Magistrate Judges are not routinely assigned as a referral judge in criminal cases, but may be called upon to rule on routine non-dispositive pre trial motions related to the appointment of counsel, discovery and other pre trial issues. Most non-dispositive motions should first be presented to Judge Lee for consideration or referral. Unless otherwise directed, forms of order should be e-mailed, in Word Perfect or Microsoft Word format, to Judge Lee's Chambers.

- Motions to continue pre trial conferences, trials, sentencings, suppression hearings, etc. should also be presented to Judge Lee. Unless otherwise directed, forms of order should be e-mailed, in Word Perfect or Microsoft Word format, to Judge Lee's Chambers.

- If requesting a continuance, please specify what time period is need in the motion (e.g. 30 days, 60 days, etc.). If you are requesting a continuance beyond the limitations of the speedy trial act, Judge Lee will generally require a hearing, with the defendant present, before such a motion may be granted.
