Harrison Street Fort Wayne, IN 46802 (260) 423-3030 Scheduling - Magistrate Judge Roger Cosbey conducts all arraignments and enters Arraignment Scheduling orders at the completion of that proceeding, scheduling the trial and final pre trial conference on Judge Lee's calendar. The trial is generally scheduled 30-60 days from the date of the arraignment, with a pre trial conference scheduled for approximately one week prior to the trial. The Arraignment Scheduling order also sets the time frame for discovery, the procedure to be followed if a discovery motion needs to be filed, and establishes the pre trial motion filing deadline. The Arraignment/Scheduling order advises counsel of the issues to be discussed at the final pre trial conference and directs that proposed instructions and proposed voir dire questions are to be filed prior to the final pre trial conference - Counsel are advised at the arraignment that the pre trial conference date is the deadline for the taking of a plea. If a plea agreement is filed prior to the final pre trial conference, the case is then referred to Magistrate Judge Cosbey for the taking of the plea and issuing of a Report and Recommendation thereon. The jury trial date is VACATED upon the filing of the plea agreement. - If a plea agreement is not filed prior to the date of the final pre trial conference, Judge Lee will conduct the final pre trial conference. Because multiple trials are scheduled on the trial start day, the order of proceeding will be resolved during the course of the final pre trial conference. - If it appears that more than one case can be tried in a week, Judge Lee will select more than one jury on the day of trial. The jury for the case to be tried second will be selected first, then sent home with instructions to return on another day to commence the trial.
