Motions in Criminal Cases

Non-dispositive motions are generally ruled on by the Magistrate Judge assigned to the case. This includes motions to continue criminal trials. The proposed order should be submitted in Word Perfect or Microsoft Word format to the Magistrate Judge by e-mailing it to his chambers mailbox, either Judge Cherry's chambers mailbox or Judge Rodovich's chambers mailbox.

The major exception to this rule is that motions to continue sentencing and motions to suppress are decided by Judge Simon. A proposed order on a motion to continue sentencing should be sent in Word Perfect or Microsoft Word format to Judge Simon's chambers mailbox.

A motion for a continuance should specify what time period is requested (e.g. 30 days, 60 days, etc.).
