Judge Leichty: Criminal Trial Procedures

Counsel must ask permission to approach the witness and bench. Counsel need not use the podium, but in that instance must wear a microphone for the benefit of the court reporter and jurors. The court expects counsel to stand, if they are able, when questioning witnesses and when addressing the court.

All exhibits are to be marked before trial, and copies are to be furnished to opposing counsel and the court with an exhibit list no later than the morning of trial. The government and any defendant should mark their exhibits using numbers.

During deliberations, Judge Leichty allows jurors to use handwritten notes that they have taken at trial.
