Judge Miller: Change of Plea

The magistrate judge ordinarily ocnducts change of plea hearings in Judge Miller's cases, but Judge Miller conducts the hearings of the magistrate judge is unavailable or the parties choose not to consent. If the magistrate judge conducts the hearing, the magistrate judge does not accept the plea, but rather enters a report and recommendation to Judge Miller. If Judge Miller is to conduct the change of plea hearing, counsel should call chambers at (574) 246-8080 to schedule a hearing date. If there are special circumstances (e.g., the defendant requires an interpreter or is unable to read), the courtroom deputy should be advised as soon as possible.

A sentencing date will be scheduled at the change of plea hearing, whether Judge Miller or the magistrate judge conducts the hearing.
