Judge Miller: Instruction Conference; Timing of Final Argument

Judge Miller conducts instruction conferences on the record, immediately after or reasonably near the close of all the evidence. Judge Miller will tender a proposed set of final instructions based on the instructions the parties tendered, along with an explanation of the sources of those proposed instructions and a set of proposed rulings on the instructions the parties tendered.

Unless asked to do things differently, Judge Miller will read all instructions except those about deliberatoins before the final arguments.

Each juror will receive a set of the final instructions to follow during their reading and to take to the jury room during deliberations.
