Judge Lee: Informal Exchange of Discovery

Effective December 1, 2000, absent congressional action, the voluntary disclosure provisions of revised Federal Rule of Civil Procedure 26(a)(1) will apply nationwide, except in specified types of cases. District Courts will no longer be permitted to "opt out" of this rule. The court has therefore included reference to Rule 26(a)(1) disclosures in its Order of (preliminary) Pretrial Conference that will be sent to counsel after filing of a complaint.
