Unless otherwise indicated in the scheduling order, the parties must submit proposed final jury instructions (with authorities) and verdict forms the Wednesday the week before trial (by noon ET). The parties should submit these materials in Word (not PDF) to chambers at email@example.com, and electronically file the same on the docket. The court will file its proposed final jury instructions before this deadline, and the parties should accordingly not submit duplicative instructions.
Judge Leichty conducts instruction conferences on the record, immediately after or reasonably near the close of all the evidence. Judge Leichty will tender a proposed set of final instructions, with authorities, based on the instructions the parties submitted and based on the issues and evidence presented in the trial. Each juror will receive a set of final instructions, without authorities, to take to the jury room during deliberations.
