Judge Van Bokkelen: Pretrial Motions

Non-dispositive motions, motions to continue trial, and the related proposed orders should be directed to the magistrate judge assigned to the case. All other motions (i.e., motions in limine, motions to suppress, motions to change a plea, or motions related to sentencing) should be directed to Judge Van Bokkelen.

Motions for continuance must specify how much time is needed (e.g., thirty, sixty days, etc.), and the section of the Speedy Trial Act that excludes the time period from computation under the Speedy Trial Act. Proposed orders must mirror motions to continue and, if continuance is requested under 18 U.S.C. § 3161(h)(8)(A) (ends of justice), the motion and the proposed order must specifically state the reasons for continuance as required by that section.
