Judge Simon: Motions in Criminal Cases

Non-dispositive motions, including motions to continue criminal trials, are generally ruled on by the Magistrate Judge assigned to the case. The major exception to this rule is that motions to continue sentencing hearings and motions to suppress are decided by Judge Simon.  A list of non-dispositive motions is available at http://www.innd.uscourts.gov/sites/innd/files/DispositiveLogic.pdf.

A motion to continue should specify the length of the continuance requested (e.g., 30 days, 60 days).

Proposed orders for motions should be in WordPerfect or Microsoft Word format and should be emailed to simon_chambers@innd.uscourts.gov or the Magistrate Judge who will handle the motion.
