Judge Theresa Lazar Springmann: Pretrial Motions

Non-dispositive motions and the related forms of order should be directed to the magistrate judge assigned to the case. All other motions (i.e., motions in limine, motions to suppress, and motions to continue the trial) should be directed to Judge Theresa Lazar Springmann.

Motions for continuance must specify what time period is needed (e.g., thirty, sixty days, etc.), the section of the Speedy Trial Act that excludes the time period, whether the motion is unopposed, that defense counsel has personally discussed the need for a continuance with the defendant, and that the defendant understands the period of delay is excluded. Proposed forms of order must mirror motions to continue and, if continuance is requested under 18 U.S.C. § 3161(h)(7)(A) (ends of justice), the proposed form of order must specifically state the reasons for continuance as required by that section.
